CODE OF CONDUCT FOR SPAZE PRIVY RESIDENTS

A.    PROMULGATION

1.      The “Code of Conduct for SPAZE PRIVY Residents”, Short Title “PRWA CODE OF CONDUCT”, is hereby promulgated vide Resolution No _________, approved at the General Body Meeting (GBM) No ___/2018, held on ________ 2018.

2.      Any modification to these codes would need the approval of the General Body.

3.      In case of urgency, the Governing Council is authorized to issue temporary amendments but the same would need ratification of GBM within 02 months.

4.      Copies of these Codes are to be posted on the RWA’s website and provided to each resident in electronic form.

B.    DEFINITIONS

1.      Owner : The person having the title of the flat.  This term shall include allottee(s), when the flat has not yet been registered in their name.  In case of joint ownership, this term shall include both the owners.

2.      First Owner : The first owner in case of joint ownership.

3.      Second Owner :  The second owner in case of joint ownership.

4.      Tenant :  The person to whom the flat has been rented out.

5.      Occupant : The person actually staying in the flat.  He/she could be a tenant or relative.

6.      Resident : Includes all terms viz, owner(s), occupants and tenants.

C.    GENERAL

1.      All apartment owners and/or residents (including their family members) of Spaze Privy Society (hereinafter referred to as “Residents”) shall abide by the Bye-Laws of the Registered Privy Residents Welfare Association (hereinafter referred to as “PRWA or the RWA”) and follow all instructions of the General Body of the RWA.

2.      All residents should adhere to the basic Principles of Conduct in Society, namely  mutual respect, respect to women and elderly persons, care for children and non-interference in personal affairs.

3.      All residents must keep themselves aware of the notifications issued by the RWA by visiting the RWA’s website, checking their e-mail and WhatsApp group.

4.      It shall be the responsibility of every apartment owner and/or resident of Spaze Privy Society (hereinafter referred to as “Spaze Privy”) to ensure that:

a.       his/ her apartment is not used for any unlawful, illegal, immoral or anti-national activity;

b.      the laws, rules and instructions of the police and or any law enforcement agency regarding verification of their tenants and foreign nationals are duly complied with; and

c.       Their tenants are appraised of their obligations to remain aware and comply with the rules and regulations made by the RWA from time to time.

5.      All the Residents and their domestic help, if any, are obliged to maintain at all times a wholesome family environment in the complex.

6.      Non-compliance with these codes of conduct may attract penalties as may be prescribed hereinafter with the concurrence of the General Body.

D.    REGISTRATION WITH PRWA

1.      Every resident shall register himself/herself with the RWA by submitting a prescribed form online.  The e-mail id and mobile number provided during registration shall be considered as the authorized channels of communication with the residents and it shall therefore be their responsibility to keep it updated at all times.

2.      Registration shall be required for owner as well as for tenants/actual occupant, when the flat is rented out.

3.      Every resident, while moving-in shall get an endorsement from RWA, so that their registration process is completed and stickers/vehicle passes/identity cards etc may be provided to them.

4.      Every resident, while moving out of society or selling their property, shall take NoC from RWA, so that their records may be updated and stickers/passes/identity cards etc may be withdrawn from them.

5.      The registration shall be free for all residents, including tenants.

E.       ORDERLY CONDUCT

1.      Consumption of alcohol or any intoxicants etc. by Residents and /or their guests and domestic staff in the common areas, and smoking in the lifts and basement is strictly prohibited. 

2.      The Residents shall:

a.       contain and confine the noise level caused by any construction, maintenance and repairs in any apartment or use of musical instruments, radios, television, amplifiers and any other devices so as to ensure that other residents are not disturbed in peaceful enjoyment of their privacy;

b.      ensure not to waste water while washing the cars/watering plants etc.;

c.       endeavour to participate actively in all events being organized by RWA and celebrate festivals together; and

d.      not engage any staff of the RWA for any personal work.

F.     CLEANLINESS AND AESTHETIC APPEARANCE

1.      Residents must appreciate that the society can not be kept clean and presentable merely by the efforts of housekeeping staff.  The residents must contribute by not littering or defacing the society area.

2.      Non-payment of dues to the Maintenance Agency affects the maintenance and upkeep of premises.  Residents must therefore pay their dues for Common Area Maintenance/Electricity and for their electricity consumption to the Maintenance Agency on or before the due date, UNLESS there are any pending disputes, or it has been decided so by the RWA.  Any individual dispute must be raised in writing with the Maintenance Agency and/or the Developer.

3.      Residents shall:-

a.       Not throw or drop any garbage, trash or litter (including wrappers, packages, cigarette butts, paper, plastic bags etc) outside the disposal installations or designated areas provided for such purpose or throw any water from the windows/ balconies etc.;

b.      Spitting pan/tobacco is prohibited throughout the common areas;

c.       Not stick bills, post any advertisement or posters of any kind in or on the building except as authorized by the General Body of the RWA;

d.      ensure that the domestic pets, if any, are kept strictly following the safety and sanitation norms, and managed and maintained as per the municipal bye-laws or regulations;

e.       not dust rugs, carpets etc. from the windows and balconies, or to clean rugs, carpets etc. by beating on the exterior part of the building;

f.        collect all garbage or solid/ semi solid municipal waste in a container and dispose it off in the disposal installations or designated areas earmarked for the purpose or in the manner as may be prescribed;

g.       not lay or install or cause to be laid/ installed any wiring for electrical or telephone installation, television antennae, machines or air conditioning units, etc. on the exterior of the complex building or that protrude through the wall or the roof of the building except as authorized by the RWA; and

h.      not place or cause to be placed in common and limited areas such as lobbies, vestibules, stairways etc. any furniture, packages, cycles or objects of any kind, except while in normal transit through them.

G.    USE OF COMMON AREAS/FACILITIES AND RESTRICTED COMMON AREAS/FACILITIES

1.      No Resident shall place or cause or allowed to be placed any furniture, packages or objects of any kind in the lobbies, vestibules, stairways, elevators and other areas of the complex building and facilities of a similar nature both common and restricted, that may impede or expected to impede the smooth movement of persons or goods or may cause inconvenience to the Residents.

2.      The common or restricted areas shall not be used for any purpose e.g. storage or construction work, except where specifically authorized by the RWA, other than for normal transit and circulation.

3.      No Resident shall cause any damage whatsoever, to any asset of Spaze Privy.  In the event of so doing, the full cost incurred in repairing such damage shall be borne by the Resident who caused the damage.

4.      not damage common property like lifts, club house and the equipment, fittings and fixtures installed therein, roads, street-light poles, fittings and signages etc.;

5.      Spaze Privy has provision for passenger elevators earmarked for the use of Residents and their guests and service elevator earmarked for freight service or auxiliary purposes.

6.      Residents should use the freight or service elevator only for carrying any packages, merchandise or construction material or any such other objects which may affect the comfort or well-being of the passengers of the elevators dedicated for the use of Residents and guests. The users shall exercise due care and caution and ensure that no damage or defacing is caused to any of the elevators during the use thereof.

7.      Every Resident shall use the elevators in such a manner as not to damage them in any way.  Other than luggage, no package, box, crate or any other article shall be permitted only in service elevators.

H.    SECURITY

1.      All residents are expected to comply strictly with the security instructions issued from time to time and to co-operate with the security staff and comply with their instructions.  In case of any difference of view, matter may be discussed politely or escalated to the next level.

2.      The Residents are required to notify the security staff at the gate in advance if they are expecting any guests or any maintenance staff or any other person. The guests, visitors and maintenance workers etc. are required to sign the visitor’s register at the entrance gate, failing which entry to Spaze Privy may be denied by the security staff.

I.      PARKING OF VEHICLES:

1.      The Residents shall follow the following guidelines in this regard:

a.       It is expected that every Resident shall park or cause to park his/her/their car(s) at the assigned parking slot specifically allotted to an apartment.  Due care must be taken to ensure that no part of the vehicle is protruding outside the yellow line demarcating the boundary of the parking slot;

b.      as designated car parking slots are earmarked for each apartment, Spaze Privy parking stickers shall be issued for each apartment for regular parking of vehicles inside the building complex. These stickers should be displayed on the front windscreen of the cars of the Residents. If a new Resident joins Spaze Privy, in that case the RWA will issue temporary sticker to them for limited period of time e.g. 5 days or 10 days so that they can complete the formalities and get their new car sticker. Till the validity of temporary sticker, they can park the car in the visitor parking;

c.       entry and parking of any additional vehicle on a regular basis for any apartment inside the building complex will be regulated by the RWA;

d.      vehicles owned by Residents which does not have any assigned car parking lot will have to be subjected to the same level of security as any regular visitor wishing to enter the building complex for parking at the visitors’ car parks;

e.       as there are only a limited number of visitors’ car parks, priority will be given to visitors during normal visiting hours between 8 am to 10 pm daily;

f.        Residents who park at visitors’ car parks or at the others designated parking at surface level will be notified in writing and personally advised not to do so by the security officers in charge. Security guards may be instructed to keep track of the dates and times when such Resident’s vehicle park for long periods at the visitors’ car parks by issuing visitor parking with dates or any other method as approved by RWA;

g.       Residents are not permitted to stick their own car number plate stickers on the wall facing their allocated car parking bay;

h.      all the Residents are expected to ensure that their vehicles or taxies are not parked in the main drive-way except for drop and pick-up facility of the passengers;

i.        no Resident shall park or allow his/her vehicles to be parked in the drive-ways/ pathways demarcated for the movement of vehicles in the basement, or park two-wheelers in the area earmarked for four-wheelers;

j.        Residents should ensure that any of their guests do not park their vehicles or taxis in parking area allotted to other Residents and should only park in visitors parking;

k.       Residents should ensure that vehicles are not parked on roads and if the need arises to park them on road then they should be parked properly without obstruction to traffic.

l.        commercial vehicles of a certain size and height that are likely to cause accidental damage to the building are neither permitted to enter the car park nor permitted to be parked at the designated parking lots; and

m.     parking areas are not to be used for recreation, storage or repair works by any Residents, servant, visitor or contractor.

J.      COMPLIANCE WITH TRAFFIC RULES

1.       All residents, their family members and their guests shall observe the traffic rules as per Motor Vehicle Act diligently.  Violations may invite penalties as per the law.

2.      Special attention is to be paid to the following:-

a.       persons below 18 yrs of age and those without a valid driving license are never to be allowed to drive a motor vehicle.  Such cases may be reported to police and would invite heavy penalties;

b.      every person riding a two-wheeler, whether as a driver or pillion, must wear a helmet;

c.       the prescribed speed limits must be strictly adhered to;

d.      headlights must be kept on inside the basement, both by day and night;

e.       speed must be reduced to dead slow (<10 kmph) at speed breakers, during turns and when arriving at a T-junction;

f.        vehicles must NOT be stopped/parked, even momentarily, within 20 mts of any turn;

g.       overtaking is NOT permitted at turns.  All vehicles must keep to extreme left, especially at turns;

h.      due allowance must be given to the possibility that children or elderly persons or persons with impaired sight or hearing may be crossing the road; and

i.        horn honking is discourteous and should be avoided except when extremely necessary.

K.    REGULTION OF DOMESTIC STAFF

1.      Residents are required to get the servants, drivers, cleaners, cooks and domestic workers (hereinafter referred to as the “Domestic staff) employed by them verified by the local police and to submit a copy of the police verification to the RWA.  Entry to the complex may be denied to the domestic staff not verified by the local police.

2.      The names and other particulars of the Domestic Staff employed by the Residents should be supplied by them to the RWA. The RWA shall issue identity cards to them that must be carried by the Domestic Staff while in the complex. On termination of the employment of the Domestic Staff, it shall be the responsibility of the Resident to inform the RWA and to return the identity card.

3.      The Domestic Staff is prohibited from using the common areas for recreation, assembly or sitting unless accompanied by the Residents.

4.      Domestic Staff shall use only the areas earmarked for them in the complex area.

5.      Every Resident shall ensure that the Domestic Staff employed by him/her/them bear a good character and shall be responsible for their behavior and actions while in his /her / their service.

L.     CO-OPERATION WITH MAINTENANCE STAFF

1.      For certain maintenance work pertaining to the common area or of any flats (such as investigation and rectification of seepages), it may necessary for the maintenance staff to seek access to adjacent flats.  It shall be obligatory on the part of every resident to allow access to the maintenance staff within their premises.  In case of planned maintenance, access may be provided by prior appointment within reasonable time, but in emergency the access must be provided immediately. 

M.  ETIQUETTES ON PRWA’S SOCIAL MEDIA GROUP

1.      The WhatsApp group(s) administered by the RWA shall be used only for informal discussions and exchange of information having a bearing on matters of common interest for Spaze Privy Residents.  Greetings may however be exchanged on important occasions.

2.      No religious, sectarian or anti-national, anti social message of any kind is to be posted on WhatsApp group (s). RWA is opposed to any kind of discrimination based on caste, colour, ethnicity, religion and sex. 

3.      WhatsApp group(s) is/are NOT the correct channel(s) for official communication.  Any person seeking an authenticated official information must send a formal message on the contact number of the concerned office bearer (s) of the RWA.  Likewise, all official notifications shall be always posted on e-mail group or the PRWA’s website.  It may be repeated on WhatsApp group (s) also optionally, but not mandatorily.

4.      While discussing any topic on the WhatsApp group(s) residents must restrict their comments and observations to issues and ideas only.  Any personal differences must be discussed bilaterally.

5.      No advertisement is to be put up on the official WhatsApp group (s) of PRWA.  Residents may put up advertisements on the website on payment of a suitable fee at prescribed rates.
